suspect james holmes. families of the victims looked on. james in his red hair. his reaction, seemed dazed. the charge, 140 counts of murder of attempted murder. the attack left 12 people dead, 58 people wounded in the premiere of the batman movie 12 days ago. >> rita was shot three dames but today climbed out of her hospital bed to see the man who put her there. james holmes was back in court today to hear the charges against him. cameras were banned but holmes demeanor much the same as when we saw him last week. eyes sometimes wide open, other times staring at the floor. hair still orange. he ws charged with 24 counts of first degree murder two counts for each person killed. because prosecutors say holmes acted both with premeditation nd extreme indifference. he was also charged with 116 counts of attempted murder and for possessing an explosive device. former marine donald later was in the theater that night, one of many who came to see holmes face to face. >> when i saw him in court today he looked like an animal in a corner, but not one who fights back. a sickly animal who has b

? >> reporter: diane, good evening. tonight, we are learning that before james holmes allegedly carried out his attack and ended up,the jail behind me. he may have railed out a road map to the massacre. tonight, abc news has learned a notebook believed to be written by the suspect, james holmes, was mailed to the university of colorado, where holmes had been a student, until dropping out last month. fox news is reporting the notebook was mailed to a sigh can i tryst at the university and that it contains, quote, full details about how he was going to kill people. drawings of what he was going to do in it. drawings and illustrations. there are conflicting reports on whether the notebook arrived at the university before or after the massacre. but it apparently wasn't found until monday, during a search of the mail room. this, of course, raises questions about whether if the package had been found before last thursday, the carnage could have been avoided. the university will not confirm the existence of the notebook, but released a statement, saying it delivers the mail the same da

. >>> now to the shook shocker in the movie theater massacre, we learned james holmes was under a doctor's care at the time of the attack. a psychiatrist with a chilling specialty, schizophrenia. >> reporter: today we learned james holmes, 24-year-old accused mass murderer, was also a psychiatric patient. while attending graduate school at the university of colorado, this court filing from his attorney reveals holmes was a patient of dr. lynne fenton, who, according to her website, specializes in schizophrenia. the defense is upset that leaks to the media revealed a package holmes sent to fenton, claiming the notebook in that package and whatever it reveals is protected by doctor-patient confidentiality. the question now, what, if anything, did holmes' psychiatrist know? and if there were warnings about his plans, was she required to speak up? >> if a psychology or psychiatrist feels someone they're treating may pose a threat, in most states they are obligated to do something. >> reporter: also today, we learned investigators are scouring the mountains two hours west of denver. th

believed to be that of james holmes. the accused gunman in that movie theater shooting. what could be a road map to a massacre and abc's dan harris tells us, experts now say detailed written plans are often a hallmark of mass murders. >> reporter: tonight law enforcement officials are analyzing the notebook believed to be from the suspect james holmes. discovered in the mailroom at the university of colorado where holmes was a student. when investigators first found the package they were so concerned it too would be rigged with explosives, they sent in a robot to handle it. inside the notebook they reportedly found plans for a massacre including drawings of a stick figure gunman mowing down his victims. >> universally, mass shooters is all about revenge. he wanted to pay society back for what he believed society had done to him. and i think the note book will talk about that. >> reporter: in america's over-crowded history of mass murder nearly every perpetrator has left behind documentation. the columbine killers left voluminous diaries, diagrams of the school, and ominous videos. jar
